Article 2 - Acceptance of the general terms and conditions of sale

These General Terms and Conditions of Sale (GTC) apply to all paragliding services (baptism flights in a biplace, initiation and advanced training courses) and canyoning proposed by Ailéments.

The benefits of paragliding — biplace baptisms and training courses — are provided and invoiced by Moniteur Ailéments Parapente Canyoning Syndicate (SIREN 999 444 391). The benefits canyoning are insured and invoiced by Ailéments – Sole trader: FENET Pierre-Yves (SIREN 794 987 024). These GTC apply equally to both structures.

By making a reservation by telephone, e-mail or online, the customer declares that he/she has read these GTC and accepts them unreservedly. These GTC shall prevail over any other document. The customer acknowledges having the necessary legal capacity to contract and engage in the reserved activity.

In the context of a group or of registration for several people, the subscriber undertakes to make known and approve these general conditions of sale, as well as the legal notices and the quality charter to all participants.

Article 3 - Booking

• To take part in an activity Paragliding or Canyoning Ailéments It is mandatory to book in advance, depending on availability.
• Appointment confirmation The client must confirm the appointment the day before the date chosen to validate the weather conditions. A confirmation SMS or call will be sent to you the day before the activity with the practical information (venue, time).

Article 4 - Prices and means of payment

• The rates are displayed in Euros including VAT on the website and may be modified at any time. The applicable rates are those in force on the day of booking.
• For bi-seat baptisms and canyoning, the regulations are carried out on site, by Instant transfer or cash.
• For paragliding coursesa 25 % % deposit of the total amount is requested upon registration. It is settled by bank transfer only. The bank details are transmitted by name after registration and are never published on the website. This deposit constitutes a deposit within the meaning of Article 1590 of the Civil Code and binds both parties.
• The balance of a course is only collected once the session is confirmed. (see Article 10) and arrangements are made on the spot on the first day.

Article 5 - Services included and not included

Our prices include :

• Management by a State-certified instructor (DEJEPS)
• The loan of the technical and safety equipment necessary for practicing the activity (sail, harness, helmet, neoprene suit, harness, etc.)
• The professional civil liability insurance of the instructor

Our prices do not include :

• Transport to the meeting point or departure site
• Accommodation, food, drinks and other personal equipment
• For paragliding courses: FFVL insurance licence (see article 7)
• Optional services (photos, videos) if offered

Article 6 - Conditions of participation

Terms and conditions:

• The activities offered by Ailéments are open to all, subject to the following conditions.
• Each participant must be fit and healthy, Without any recent operation or injury on the day of the activity.
• Participants must not be under the influence of narcotics or in a state of intoxication.
• All medical constraints (asthma, diabetes, injuries, previous fractures, heart problems, etc.) must be reported to the instructor beforehand.
• The monitor reserves the right to exclude a participant if they do not follow the instructions or pose a danger to the group or themselves. In this case, no refund will be made.

Specific conditions Canyoning :

• Depending on the chosen course, level, size, weight and age will be taken into account.
• You must be able to swim at least 50 metres and put your head under the water.
• Used to heights for abseiling.
• The customer must provide suitable closed shoes (such as trainers or sports shoes). A free loan can be made if the customer does not have any.

Specific conditions Paragliding :

• We place particular emphasis on passenger weight (recommended limit: 100 kg), the ability to move and run properly in order to be active during takeoff and landing phases.
• Beyond 100 kg, the monitor is the only one to decide whether the passenger can be carried depending on the meteorological conditions, the configuration of their equipment, and their own weight. The flight time cannot be guaranteed.

Specific conditions: Paragliding courses:

• The courses are accessible from 12 to 55 years old. After 55 years of age, participation is still possible after a preliminary telephone conversation with the school.
• Weight between 30 and 90 kg (The limit of 100 kg mentioned above applies to baptisms in a two-seater).
• Good physical condition required A stage involves several hours of standing in a steep schoolyard, repeated takeoffs and landings on natural terrain. Days begin at 8 a.m. and end late.
• Each participant must first report any prosthesis, joint or spinal pathology, any treatment or disorder affecting balance, alertness, or decision-making.
• The Perfectionnement and Discovery of Southern Sites internships are reserved for autonomous pilots for takeoff and landing.

Minors :

• Minors must be accompanied by a responsible adult or provide a written, signed parental consent.
• Minimum age and weight vary depending on the activity – please consult us.

Pregnant women:

• Paragliding and canyoning are not recommended for pregnant women.

Medical certificate :

• For the paragliding courses (outside the two-seater baptism), one Medical certificate stating that there are no contraindications to practicing hang-gliding and sustained physical activity, issued within the last 3 months, It is mandatory. It must be presented on the first day of the course. Otherwise, the course cannot begin and no refund will be given.
• Each participant also declares, on oath, when registering, that he/she has become aware of the FFVL form on medical contraindications to the practice of paragliding and that he/she does not believe in it.

Risk awareness :

• The activities proposed by Ailéments are practised in a specific environment (unsafe natural environment). All participants acknowledge that they are aware of the risks inherent in outdoor sporting activities.

Article 7 - Insurance and liability

Instructor's insurance :

• All our instructors within Ailéments are State-qualified (DEJEPS), approved for youth and sports, and fulfill all the current legal obligations.
• They have a professional indemnity insurance covering the management of the proposed activities. All supporting documents are available on request.

Participant insurance :

• We strongly advise you to be individually insured for civil liability for damages caused or suffered in incidents or accidents that have no direct connection with the practice of the activities or that are not the result of the monitor or a failure of the equipment.
• For tandem paragliding first flights The passenger is covered by the professional civil liability insurance of the instructor.
• For paragliding courses : each student must necessarily hold a FFVL licence and insurance (French Federation of Free Flight) in force, including an Air Liability Insurance (RCA), before the first day of the internship. The cost of this license is not included in the course fee and remains the responsibility of the student.
• The student subscribes to their license directly with the FFVL, online on intranet.ffvl.fr. Ailéments The license number must be provided when registering; check it before the start of the internship.
• In accordance with Article L321-4 of the Sports Code, Ailéments inform his trainees of the benefits of subscribing to insurance options Individual accident and repatriation assistance proposed during the FFVL license acquisition.

Limitation of liability :

• In the event of a bodily injury, the responsibility of Ailéments the instructor and the emergency response team is discharged as soon as the victim is taken over by the competent rescue agencies (fire department, PGHM, ambulance service). Any hospital treatment or repatriation will be the responsibility of the injured person's personal insurance policies.

Article 8 - Equipment

• The equipment loaned by Ailéments (sail, harness, helmet, suit, harness, etc.) remains the property of 'Ailéments'.
• The customer is responsible for the equipment entrusted to him/her. for the entire duration of the activity.
• In the event of loss, theft or damage attributable to the customer, the cost of repair or replacement will be invoiced to the customer at the current selling price of the equipment.

Article 9 - Gift vouchers

• Ailéments gift vouchers are valid 1 year from the date of purchase.
• Although gift vouchers are nominative, they can be transferred free of charge to a third party. To do this, the original beneficiary must contact Ailéments the call us to provide the name of the new beneficiary.
• Gift vouchers may not be resold under any circumstances.
• The reservation of a gift voucher is subject to the same cancellation conditions as conventional reservations (see article 10).

Article 10 - Cancellation

Cancellation by the customer :

If you wish to cancel an activity (including a gift voucher) :

• The balance paid will be repaid in full if Ailéments is informed at least 20 days before the date of the activity.
• The balance will be reimbursed to you at 50% if Ailéments is informed for at least 10 days before the date of the activity.
• The balance paid will not be refunded if Ailéments is informed 8 days or less before the date of the activity.
• In the event of deposits paid: if the cancellation occurs within the above deadlines, the deposits will be refunded under the same conditions. If the cancellation occurs outside these deadlines, the deposits will be retained by Ailéments.

Cancellation of a paragliding course by the client:

• Cancellation at more than a month From the first day of the course: the deposit is not refunded but remains transferable to another session within twelve months.
• Cancellation between one month and two weeks before the first day: the deposit remains transferable for another session, subject to availability.
• Cancellation at less than two weeks From the first day: the deposit is finally acquired at Ailéments.

Cancellation by Ailéments :

• Ailéments, concerned for your safety and your enjoyment, reserves the right to cancel or postpone a tour if the weather conditions are weather conditions are not favorable on the day of the activity.
• What's more, in canyoning, if the minimum number of people If the departure is not reached (minimum 5 people according to the canyons), the departure may be cancelled.
• For the paragliding courses (Initiation, Improvement, Discovery of sites in the South), one Minimum of 6 participants is necessary for the session to be maintained. Ailéments confirms or cancels the session at least 4 days before First day. The discovery day is subject to no minimum requirements.
• In the event of cancellation by Ailéments the customer, the full amount will be refunded or a later date will be offered according to their preferences.

Article 11 - Delay

For the smooth running of the activity and out of respect for the other participants and the instructor, Ailéments does not tolerate delays of more than 15 minutes.. Once this period has elapsed, the instructor may go on activity and no refund or compensation will be payable.

Article 12 - Theft and damage

The customer is warned that it is strongly advised not to bring or leave valuable items in a vehicle during the activity.

The Ailéments instructors are in no way responsible or liable for any loss, theft or damage to the client's personal belongings.

Article 13 – Right to an image

Ailéments It grants you the right to use your image for promotional and advertising purposes, regardless of the media used (paper, video, internet).

If you do not wish to appear, you can send us your request by registered post with acknowledgement of receipt.

In accordance with Law n°78-17 of January 6, 1978 relating to information technology, files and liberties, you have the right to access and withdraw or delete information about you.

Article 14 - Applicable law and jurisdiction

These General Terms and Conditions of Sale are governed by and subject to French law.

In the event of a dispute or disagreement, the parties will strive to resolve the matter amicably. The customer may submit a written complaint to Ailéments the company in order to seek an amicable solution.

In the absence of an amicable solution, the consumer customer may use the Ailéments consumer mediation service of their choice free of charge, under the conditions specified in Article 18.

In the absence of an amicable agreement, all disputes relating to the interpretation or execution of these GTC shall be the exclusive competence of the Commercial Court of Grasse., in accordance with the rules of ordinary law.

Article 15 - Amendment of the GTCS

Ailéments reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on its website.

The GTC applicable are those in force on the date of the reservation made by the customer.

Article 16 - Miscellaneous provisions

If any of the provisions of these GTC are declared null or inapplicable, the other provisions will remain in force.

The temporary or permanent Ailéments non-application of one or more clauses cannot constitute a waiver of the other clauses, which continue to have effect.

Article 17 — Autonomous Pilot Shuttle Service

The shuttle service for autonomous paragliding pilots is organized by the Ailéments Parapente Canyoning Moniteur Union (SIREN 999 444 391, address: 138 Impasse Augarde, 83000 Toulon), a separate professional structure. Ailéments This service is not part of the commercial services Ailéments described in the previous articles.

Beneficiaries: the service is open to union members who are instructors, to autonomous pilots who are affiliated as «user pilots» (annual fee of €10), and exceptionally to non-affiliated pilots based on an increased visitor rate.

Current prices
- Crêtes takeoff: 10 € (member) / 12 € (visitor)
- Takeoff of the 300: 5 € (member) / 6 € (visitor)

The fees are set by resolution of the union's board and may be subject to change; the current version is the one published on wings.fr on the date of service provision.

Access conditions: All eligible pilots must hold a valid FFVL license or an equivalent insurance certificate covering their parapent practice, and must be able to present it upon simple request. Advance booking is recommended. The association reserves the right to refuse access to the service in case of non-compliance with safety instructions, proper onboard conduct, or agreed schedules.

Payment: by bank transfer, bank card, or cash with issuance of a numbered receipt. All receipts are deposited into the union's bank account.

Cancellation due to weather: In the event of unfavourable weather conditions, the association may cancel or postpone a shuttle service without entitlement to compensation.

Liability: Pilot users and occasional beneficiaries of the service remain personally responsible for their paragliding practice and must have air liability insurance covering their activity (including through their FFVL license). The shuttle vehicle is covered by insurance suitable for transporting passengers as part of the union's activity.

Complaints: Any complaints can be made in writing to the union's headquarters or by email to write to us.

Article 18 — Mediation of consumer disputes

In accordance with Article L. 612-1 of the Consumer Code, every consumer has the right to use a consumer mediation service free of charge in order to resolve a dispute amicably with a professional.

The customer is previously required to submit a written complaint to Ailéments In order to seek an amicable solution. The referral of a mediator is admissible only in the absence of a satisfactory response, and within a maximum period of one year from that claim.

The official list of referred consumer mediators can be consulted on the website of the Commission for the Evaluation and Supervision of Consumer Mediation (CECMC): economie.gouv.fr/mediation-conso.

The use of mediation is optional. The consumer remains free to accept or reject it, and, in the event of mediation, to accept or reject the proposed solution. In any event, they retain the possibility of resorting to the competent court.
